Welcome to Buinity ("Buinity", "the app", "the platform", "the service", or "the site"), an AI-powered media generation platform developed and provided by Sita Berete ("we," "us," or "our"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our Buinity platform, available on Android, iOS, macOS, Windows, Linux, and the Web (buinity.com). Buinity allows users to generate various types of media, including images and videos.
We are committed to protecting your privacy and ensuring compliance with applicable data protection laws and regulations worldwide, including but not limited to the General Data Protection Regulation (GDPR) in the European Union, the California Consumer Privacy Act (CCPA) in the United States, the Lei Geral de Proteção de Dados (LGPD) in Brazil, and the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada.
This Privacy Policy is designed to be transparent and understandable, providing you with clear information about our data practices. We encourage you to read it carefully. Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Service.
2. Data Collection
We collect various types of information to provide and improve our services, personalize your experience, and comply with legal obligations.
- Account Information: When you create an account, we collect your email address and username/pseudonym. You may choose to sign in using OAuth 2.0 with your Google, Facebook, or Apple account, in which case we receive information provided by those services as per their privacy policies (typically your name, email address, and profile picture).
- Age: We collect your date of birth after registration for ethical and legal reasons with respect to the content you generate and view.
- Media and Prompts: When you use Buinity to generate media (images and videos), we store the prompts you enter (text, parameters, and any input images/videos) and the generated media.
- Datasets for Model Customization: When you customize a model, we store the dataset (images, videos, etc.) you provide.
- Payment Information: If you make in-app purchases, our payment processors (Google Play Store, Apple App Store, and Paddle) collect your payment details. We do not directly store your card or payment information.
- Communications: If you contact us directly, we may receive additional information about you such as your name, email address, the contents of your message, and any attachments.
- About content visibility:
- Public vs. Private: Premium users can choose to make their generated media and custom models public or private. Free users' generated media are always public. Generated media are always linked to the input prompts (text prompt, parameters, and input images/videos) used to create them and can't be separated from them. Which means that if you make a generated media public, the input prompts will also be public. Images flagged as containing NSFW content are automatically made private (and can't be made public) and inaccessible even to the user who generated them if they are under the specified age limit.
- Custom Model and Dataset: Users who customize our base models can choose to make the resulting model and/or the training dataset public or private, independently of each other.
To provide, improve and secure our services as well as reasons mentioned in the "Data Usage" section, we collect the following information automatically:
- Usage Data: We collect information about how you interact with Buinity, such as the features you use, the frequency of use, and the duration of your sessions.
- Device Information: We may collect information about the devices you use to access Buinity, including device type, operating system, unique device identifiers, and IP address.
- Crash Reports & Log Data: Our services may collect crash reports and log data to diagnose technical issues and improve the app's performance. This data may include information about your device, operating system, and the circumstances of the crash.
3. Data Usage
We use the collected data for the following purposes:
- Provide and Maintain the Service: To create and manage your account, process your requests, deliver the media generation service, and provide customer support.
- Improve the Service: To analyze usage patterns, diagnose technical issues, develop new features, and enhance the overall user experience. This includes using public generations, public models, and public datasets to improve the underlying AI models for all users. Private content is not used to train or improve the service in general, but used for the sole purpose of providing the service to the user who created them.
- Legal Compliance: To comply with applicable laws, regulations, legal processes, or enforceable governmental requests.
- Personalize Your Experience: To tailor content and recommendations based on your preferences and usage.
- Display Ads: To display advertisements to non-premium users through Google Ads Manager, which helps fund the development and maintenance of Buinity.
- Process Payments: To facilitate in-app purchases through our payment processors.
- Communicate with You: To send you service-related updates, respond to your inquiries, and provide customer support.
4. Data Sharing
We may share your information in the following circumstances:
- With Third-Party Service Providers, Consultants, and other Business Partners: We may share Your personal information with these parties in order to provide services on our behalf, monitor and analyze the use of our services, contact You, and for the reasons stated in the Agreement.
- Public Content: If you are a non-premium user or a premium user and choose to make your generated media, custom models, or datasets public, they will be visible to all Buinity users, including unregistered visitors. This includes the input data (prompts, parameters, and input images/videos) used to create the public content.
- Legal Requirements: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).
- Business Transfers: In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred as part of the transaction. We will notify you via email and/or a prominent notice on our app of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
- With Your Consent: We may share your information with other third parties with your explicit consent.
5. Legal Bases for Processing
We process your personal data based on the following legal grounds, as required by the GDPR and other applicable laws:
- Consent: We rely on your consent for processing data for specific purposes, such as displaying personalized advertisements and using cookies for analytics. You have the right to withdraw your consent at any time.
- Performance of a Contract: We process data necessary to perform our contract with you, such as creating and managing your account and providing the media generation service.
- Legitimate Interests: We may process data based on our legitimate interests, such as improving our services, preventing fraud, and ensuring the security of our app, provided that such interests are not overridden by your data protection rights.
- Legal Obligations: We process data to comply with legal obligations, such as responding to legal requests.
6. User Rights

- Right to Rectification: You have the right to request that we correct any inaccurate or incomplete personal data.
- Right to Erasure ("Right to be Forgotten"): You have the right to request that we delete any of your Personal Information that we collected from you and/or retained. Unless subject to a certain limited exception, once we receives and confirms your verifiable data deletion request, we will delete (and direct our service providers to delete) your personal information from our records. We will notify you promptly if we determines we must deny your deletion request.
- Right to Restrict Processing: You have the right to request that we restrict the processing of your personal data under certain circumstances.
- Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format and to transmit it to another controller.
- Right to Object: You have the right to object to the processing of your personal data under certain circumstances, including processing based on legitimate interests or for direct marketing purposes.
- Right to Non-Discrimination (CCPA): We will not discriminate against you for exercising your CCPA rights.

6.1 Account Deletion
You can delete your Buinity account by:
- Opening the Buinity app
- Selecting "Account" from the main menu
- Scrolling down if necessary and selecting "Delete Account" and confirming the deletion
After you delete your account, you will have 7 days to recover it by logging in again. After 7 days, unless otherwise required by laws or regulations, your account and all associated data (Account ID, Email, Date of Birth, Username, records of generation) will be permanently deleted from the platform and cannot be recovered. Public content you created will remain public, but your account will no longer be associated with it. We may retain Crash Reports & Log Data for up to 90 days.
7. Third-Party Services
Buinity integrates with third-party services, to provide certain features and functionalities. These third-party services include:

8. Data Retention
We retain your personal data for as long as necessary to fulfill the purposes for which it was collected, including providing the service, complying with legal obligations, resolving disputes, and enforcing our agreements.
- Account Information: We retain your account information for as long as your account is active or as needed to provide you with the service.
- Media and Prompts: Images and prompts are stored to facilitate the functionality of Buinity. Public media, models, and datasets may be retained indefinitely provide a rich user experience.
- Usage Data and Log Data: We retain usage data and log data for analytical purposes for a reasonable period.
- Payment Information: Payment information is retained by our payment processors according to their respective retention policies.
9. Security Measures
Security of your data is important to us. We implement appropriate technical and organizational measures to protect your personal data from unauthorized access, use, disclosure, alteration, or destruction. These measures include:
- Encryption: We use industry-standard encryption to protect data transmitted to and from our servers.
- Secure Storage: We store your data on secure servers with restricted access.
- Access Controls: We limit access to your personal data to authorized personnel who need it to perform their duties (such as customer support).
- Regular Security Assessments: We regularly assess and update our security practices to address potential vulnerabilities.

10. Children's Privacy
Buinity is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us at support@buinity.com. If we become aware that we have collected personal information from a child under 13 without verification of parental consent, we will take steps to remove that information from our servers.
11. International Transfers
Your information, including personal data, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.
If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including personal data, to the United States and process it there.
12. Advertising and Analytics
- Google Ads Manager: We use Google Ads Manager to display ads to non-premium users. Google may use cookies and other tracking technologies to collect information about your activity on Buinity and other websites to provide you with targeted advertising. You can opt out of personalized advertising by visiting Google's Ads Settings (https://adssettings.google.com/).
- Firebase Analytics: We use Firebase Analytics to collect information about how users interact with Buinity. This information helps us improve our app and understand user behavior. Firebase Analytics may use cookies and other tracking technologies. You can learn more about Google Analytics and how to opt out here: https://tools.google.com/dlpage/gaoptout.
We use third-party payment processors (Google Play Store, Apple App Store, and Paddle) to handle purchases and subscriptions. We do not collect or store your payment card details. When you make a purchase, you are providing your payment information directly to the payment processor, and their privacy policy will govern the use of that information.

We and our third-party partners may use cookies, web beacons, and other tracking technologies to provide features such authentication,
or collect information about your activity on Buinity. Cookies are small data files that are placed on your device when you visit a website.
We use cookies for various purposes, including:
- Essential Cookies: These cookies are necessary for the operation of Buinity and enable you to navigate the app and use its features.
- Performance Cookies: These cookies collect information about how you use Buinity, such as which pages you visit most often. This information helps us improve the performance of our app.
- Functionality Cookies: These cookies allow Buinity to remember choices you make (such as your username or language preference) and provide enhanced, more personalized features.
- Targeting Cookies: These cookies are used to deliver advertisements that are more relevant to you and your interests.
You can control cookies when prompt, or in the Buinity app settings under legal section click on "data control" or through your browser settings.
15. Policy Updates
We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top. We may also notify you via email or through a prominent notice within the app.
You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
16. Regarding Private Content
For content you designate as "private" (including generated media, custom models, and datasets), we agree to use commercially reasonable efforts to prevent such content from being displayed publicly through the normal functionality of the Buinity application. However, if you share a direct link to any private content with another person, that person and anyone else with whom they share the link will be able to view the content, irrespective of its private designation within the Buinity platform.
